OUR COMMITMENT:
We are committed to protecting your privacy. We use the personal information you give us, such as your billing, delivery and e-mail addresses, to process and keep you informed of your order. You may, from time to time, receive information from us about new services and special offers we think you'll find valuable. Under no circumstances do we rent, trade or share your e-mail address with any other company for marketing purposes.
CHOICE TO OPT-OUT:
If you are no longer interested in receiving announcements and other marketing information from us, please e-mail your request to marketing@period-art.com with the title "Remove Me" in the subject line. Please include your complete name and mailing address (as well as your e-mail address) if you prefer not to receive direct mail postcards or catalogues from us.
YOUR AGREEMENT:
By using our website or purchasing a product from us, you agree to the collection and use of information as set forth in this privacy policy.
DISCLAIMER AND LIABILITY
We reserve the right to change, modify, substitute or remove without notice any information on the site from time to time. We will endeavor to ensure that all descriptions and illustrations of the items on the site or otherwise provided to you by us are accurate but there may be slight variations due to print, photography and publishing limitations.
INTERNATIONAL CUSTOMS IMPORT DUTIES
Period Art is unable to accept responsibility for charges levied by other countries as customs policies vary widely from country to country. We suggest you contact your local customs office for further information. Please also be aware that cross-border shipments may be subject to opening and inspection by customs authorities. If the destination country imposes import duties and/or taxes, the customer is responsible for their payment. Usually there are no duties for paintings shipped in small quantities.
RETURNS POLICY - BESPOKE PAINTINGS AND PORTRAITS FROM PHOTOGRAPHS
We are unable to refund paintings that are personally and specifically designed for a customer. This includes portrait paintings of people, animals and houses plus bespoke and "inspired by" fine art replicas. All paintings will be of the same standard as shown on the website page entitled Gallery of Our Work and the portrait pages, which show examples of our portrait work. The client can also request unlimited changes until he/she is satisfied. However, since Period Art will be unable to resell such paintings, no money back offer can be given.
COPYRIGHT POLICY
Copyright lasts for the lifetime of the artist plus a period of 70 years from the end of the year when he or she dies. Period Art, therefore can only reproduce paintings by artists who have entered into the public domain prior to 1939. In terms of photographs or images supplied to Period Art, it is the customer's responsibility to make sure these images are either copyright free or that the customer has permission to use and supply the images to Period Art. In short, it is the responsibility of the customer to ensure that no photographs or other material supplied to Period Art are in breach of copyright laws. Period Art warrants that the customer either owns or has obtained copyright(s) or copyright permission to any image which is supplied to Period Art for use/reproduction and the customer agrees to assume full legal and financial responsibility for any copyright suit or action which may take place regarding materials customer has supplied.
RETURNS POLICY - FINE ART REPLICAS
On completion of your fine art reproduction you will be sent a photo of your oil painting. Should you wish to make any alterations no matter how slight, your artist will be happy to do so. We want you to be delighted with your painting. If, on the rare occasion an error has been made by Period Art, Period Art will redo the oil painting at their expense. If, for whatever reason you are unhappy with the painting and would like changes made, you must tell Period Art immediately at this stage as once the painting has been approved by you at photo stage, Period Art cannot offer you anymore alterations and no returns can be made. Unfortunately, since all of our art reproductions and portraits are custom-made no refund can be given.
NON-REFUNDABLE DEPOSIT
Period Art requires a non-refundable deposit of 50% of the total amount to commission your portrait or art reproduction. Upon approval and completion of your artwork you will be asked to settle the remaining balance. On the rare occassion you are not happy with your painting, your artist will be happy to make any changes that you require until you are satisfied. If you are still unsatisfied with your painting and no longer wish to receive your painting, you will of course lose your non-refundable deposit but you will not be asked to pay the remaining balance.
DATA PROTECTION POLICY
Period Art fully endorses and adheres to the principles of Data Protection as set out in the Data Protection Act 1998.
Any personal data which we collect, record or use in any way whether it is held on paper, on computer or other media will have appropriate safeguards applied to it to ensure that we comply with the Data Protection Act 1998 ('Act'). We fully endorse and adhere to the eight principles of Data Protection as set out in the Act. These principles state that personal data must be:-
- fairly and lawfully processed
- processed for specified and lawful purposes and not in any other way which would be incompatible with those purposes
- adequate, relevant and not excessive
- accurate and kept up to date
- not kept for longer than is necessary
- processed in line with the data subject's rights
- kept secure
- not transferred to a country which does not have adequate data protection laws.
LEGAL GOVERNANCE
Your use of this site and any contract between you and Period Art for the sale of paintings shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales.
